SALE AND PURCHASE OF GOODS

Orders/Your Contract with Us
  1.1

All orders are subject to acceptance and availability. If the item you have ordered is not available from stock you will be contacted by e-mail or phone (if you have given us details) and you will have the option either to wait until the item is available from stock or to cancel your order.

  1.2

All prices are inclusive of VAT at the current rates and are correct at the time of entering information. However, we reserve the right to change prices without prior notice to you.

  1.3

Any order made by you will be treated as an offer to purchase goods from us. A contract between you and us will only be constituted when we despatch the goods to you or when we debit your credit or debit card, whichever is the earlier. We reserve the right to reject any offer to purchase made by you at any time. You acknowledge that any automated acknowledgement of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods advertised on the website.

  1.4

Goods are sold on the condition that they may not be resold to the public.

  1.5

You warrant that the information which you are required to provide when you make an offer to buy goods via the website is true, accurate and complete in all respects.

  1.6

You may not order from us unless you are over the age of 18, and you must not be registered blind, or partially sighted.

  1.7

All glasses will be prepared in accordance with and to the specifications of the prescription provided by you. We strongly recommend that all prescriptions provided to us must be the result of a sight test performed within the last 2 years. If you are unsure of the appropriate prescription to be applied, you should consult a registered ophthalmic optician before placing an order.

  1.8

Unless your prescription (or you) states otherwise, we will apply an appropriate average pupillary distance (PD) to complete your order. Please refer to [LINK TO PD PAGE] for further information on pupillary distance. The aforementioned average PD shall be 63mm for bifocal and single vision distance lenses, or 60mm for single vision reading lenses. We will not accept or fulfil orders for varifocal or progressive lenses.

  1.9

We will not accept or fulfil orders for lenses of 8 dioptres and over. Nor will we accept or fulfil orders for lenses where the sphere value added to the cylindrical value equals 8 dioptres and over.

  1.10

We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we are not liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

  1.11

Your Glasses are covered by a one-year guarantee from date of purchase; this is relevant only to the failure of the product due to manufacture error and not accidental loss or damage.

       
2.

Right of Cancellation

  2.1

You have the right to cancel any contract within 14 days of receipt by you of the goods.

  2.2

If you do cancel a contract pursuant to this clause, you must:

  (a) notify us in writing to Specs2you® Limited, 54 Paynesfield road, Tatsfield, Kent. TN16 2BG.
  (b) ensure that the goods are returned or are made available for collection (as the case may be) in the same condition as it was when it was delivered to, or collected by, you (as the case may be).
  2.3

If you do cancel a contract pursuant to this clause, we will refund the monies you have paid to us within 30 days of you giving us cancellation notice.

       
3.

Inspection of goods

 

Upon delivery of the goods, you should inspect them carefully. If any of the goods are damaged, please contact us to inform us accordingly and do not use the goods. Each of the goods will contain written confirmation of the prescription of the goods. If the prescription stated does not match the prescription ordered, please contact us to inform us accordingly and do not use the goods.

Your Personal Data

  4.1

We respect your personal information and undertake to comply with applicable Data Protection legislation from time to time in place.

  4.2

We confirm that any personal details which you provide to us from which we can identify you are held in accordance with our Data Protection Registration. We may use the information for the following purposes:

  (a) processing your order;
  (b)

for statistical purposes to improve the service we give to you;

  (c)

to administer our business;

  (d)

unless you have already objected during the registration process, to notify you of products or services that may be of interest to you; and

  (e)

unless you have already objected during the registration process, to be disclosed to other relevant third parties, who may contact you about their products or services that may be of interest to you.

Subject to your rights of objection set out above, and your right of objection in the registration process, you agree that you do not object to us, or third parties contacting you for any of the above purposes whether by fax, telephone, e-mail, in writing or by SMS (text message) and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Telecommunications (Data Protection and Privacy) Regulations 1999.

  4.5

In the event that your personal information is no longer used by us for the purposes outlined in clause 4.2, we will delete it except insofar as it is necessary to retain such information to comply with other relevant or applicable law.

  4.6

In the event that your personal data becomes untrue, inaccurate or incomplete, or in any event, you have the right to access your personal data and may rectify the same.

Payment

  5.1

Payment can be made by any major credit or debit card. Payment will typically be debited and cleared from your account before the despatch of your goods to you.

  5.2

All credit/debit card holders are subject to validation checks and authorisation by the card issuer and we may share your personal information with such third parties as are necessary to enable us to do such checks. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

Delivery

  6.1

Unless agreed otherwise in writing:

    6.1.1

delivery of the goods will take place at the delivery address stated on the order form;

    6.1.2

delivery of the goods must be to a UK address; and

    6.1.3

delivery of the goods will take place within 28 days.

  6.2

Any dates specified by us for delivery of goods are intended to be an estimate and time for delivery is not guaranteed. If no dates are specified, we will endeavour to deliver within a reasonable time.

  6.3 If for any reason (not due to our fault) you do not accept delivery of any of the goods in accordance with this paragraph then we may charge you an additional fee to cover any reasonable additional direct costs incurred by us as a result (including additional insurance, delivery, storage or similar charges). Prices exclude delivery.

Events beyond our reasonable control

 

We will not be held responsible for any delay or failure to comply with our obligations under these terms and conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the website shall remain at all times vested in us or our licensors. Any communications between us regarding this contract that are required to be in writing must be sent by first class post, facsimile or delivered by hand. Any written communication will be treated as having been served on the addressee 3 working days after posting (if sent by first class post), at the time of transmission (if sent by fax and a satisfactory transmission report is obtained) and at the time of delivery (if delivered by hand).

While we will use reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, whether express or implied in relation to its accuracy.

The website is provided on an "as is" basis without any representation made and we make no warranties of any kind, whether express or implied, in relation to the website, or any transaction that may be conducted on or through the website including but not limited to, implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade. in any case whether or not such losses were within the contemplation of either of Us at the date on which the event giving rise to the loss occurred, was suffered or incurred by one of Us arising out of or in connection with the provisions of any matter under these terms and conditions.

Nothing in the terms and conditions shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our servants, agents or employees. Notwithstanding any other provision in these terms and conditions, nothing herein shall limit your rights as a consumer under English law.
